Proposed Facilities Policy Violation Procedure (1 September 1994, jnw@cis.ufl.edu) 1. Determination of Occurrence of an Offense. Computer System Administrators are responsible for determining when it is probable that a facilities policy violation has occurred, and in determining those persons who have probably committed such violations. 2. Recording Judgments of Guily. Record of judgments of guilt in facilities policy violation cases shall be maintained by the department chairman. 3. Procedure to be Followed By System Administrator Upon Determining a Violation has Probably Occurred. If a system administrator determines there is cause to believe a facilities policy violation has taken place, that administrator is empowered to take action which may include suspending all account privileges for any computer account that is being employed to violate policy, until one of the following shall occur: i) It is deemed that the violation was probably the result of actions by a person other than the account owner and appropriate actions have been taken to prevent further abuse. ii) The account owner is reasonably suspected of commiting a policy violation, that person is a faculty or staff member, and the matter has been referred in writing to the Department Chairman or other appropriate supervisor. iii) The account owner is reasonably suspected of commiting the policy violation, that person is a student, and the student has either completed a Facilities Policy Violation Summary Adjudication Form prepared by the system administrator, or had a hearing before the Facilities Policy Violation Committee (hereinafter referred to as the Committee). The Facilities Policy Violation Summary Adjudication Form may only be used if the suspected policy violation if the student has not been deemed guilty in a previous facilities policy violation proceeding (as determined by consulting departmental records). The Committee shall hear the case including testimony of the student, system administrator, and any other witnesses the student or system administrator wish to bring and who are determined by the Committee to be able to give testimony that has bearing on the case. The Committee shall be responsible for determining what, if any, academic sanctions are appropriate remedies in the case in question. Appeal of Committee decisions is to the Academic Dean of the College in which the student is enrolled.
